Welcome to Fever | Yoga Cycle Strength (“we”, “us”, “our”, “Fever”). These Terms of Service (“Terms”) govern your use of our website, services, classes, products and any related offerings (collectively, the “Services”) accessible via https://feverycs.com (the “Site”). By accessing or using the Site or Services, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not access or use the Site or Services.
1. Our Services
We provide fitness and wellness classes including yoga, cycle, strength-training sessions, workshops, memberships, digital content, and related products (as described on our Site). Use of the Services may require registration, payment, and acceptance of any additional policies (e.g., membership rules, cancellation policy).
2. Accounts & Registration
If you create an account with us, you agree to:

Provide accurate, complete and current information.

Maintain and promptly update your account information including a current and active credit card kept on file. A credit card is mandatory to incur services.

Be solely responsible for all activity that occurs under your account.

Keep your password and account secure, and notify us immediately of any unauthorized use.
We reserve the right to suspend or terminate accounts or refuse service at our discretion, without prior notice, for any user who breaches these Terms.
3. Payment, Memberships & Refunds
You agree to pay all fees for Services you purchase, according to the pricing, billing, and payment terms presented at the time of purchase. All class reservations cancelled within 3 hrs of the class start time will incur a fee. All class reservations not kept and not canceled according to our cancellation policy will occur a fee.
Studio Memberships (5, 8, Unlimited Tier) renew automatically after the 3 month commitment unless you cancel in accordance with our cancellation policy which is 30 days prior to the next scheduled payment (as described on the Site). Our Intro Month, Drop-in, 10 Class Package, Year Paid In Full are 1X purchases and will NOT automatically renew.
We do not offer refunds on purchases or cancellation fees. All sales are final.
We reserve the right to change fees, membership terms, or billing frequency.
4. Acceptable Use
You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not:

Use the Services in any way that violates any applicable law or regulation.

Post or transmit content that is unlawful, defamatory, obscene, abusive or that infringes the rights of others.

Interfere with or disrupt the Services or servers or networks connected to the Services.

Attempt to gain unauthorized access to any portion of the Services, other accounts, or computer systems.

Use the Services in any way that could damage, disable, overburden or impair the Site or Services.
We may monitor use of the Services and may suspend or terminate access for any user whom we believe has violated this section.
5. Intellectual Property
All content on the Site and delivered through the Services — including, but not limited to, text, graphics, logos, images, audio, video, software — is the property of Fever or its licensors, and is protected by copyright, trademark and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit the content except as expressly permitted.
6. Disclaimers & Limitation of Liability
Disclaimer of Warranties: The Services and Site are provided “as is” and “as available” without any warranties of any kind, either express or implied. We do not guarantee the accuracy, completeness, reliability or suitability of the Services for your purpose.
Limitation of Liability: To the maximum extent permitted by law, in no event will Fever, its officers, directors, employees or agents be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access/use) the Services.
Our total liability to you for all claims arising out of or related to these Terms will not exceed the amount you (if any) actually paid to us in the twelve (12) months prior to the claim.
7. Health & Safety; Release
Participation in all fitness, yoga, cycle and strength-training classes involves physical exertion and risk of injury. You represent that you are physically and medically able to undertake these activities, and assume the risk of participating in the Services.
You agree to release, waive, discharge and hold harmless Fever and its affiliates, instructors, staff, agents and representatives from any liability, claims or demands arising from your participation in the Services, except to the extent caused by our gross negligence or willful misconduct.
8. Termination
We may terminate or suspend your access to all or part of the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease and you must discontinue all use. Sections which by their nature should survive termination (such as Intellectual Property, Limitation of Liability, Governing Law) shall survive.
9. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective when posted on the Site, with an updated “Effective Date” noted. By continuing to access or use the Services after changes become effective, you agree to be bound by the revised Terms. If you do not agree to the changes, you must stop using the Services.
10. Governing Law & Dispute Resolution
These Terms and your use of the Services will be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of laws provisions.
You and we each agree to submit to the exclusive jurisdiction and venue of the state and federal courts located in Kent County, Michigan for any dispute arising out of or relating to these Terms or the Services.
11. Entire Agreement
These Terms constitute the entire agreement between you and Fever concerning your use of the Services and supersede all prior or contemporaneous communications, proposals or agreements, whether oral or written.
12. Severability
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will continue in full force and effect.
